Health Reform: Can Dependents Receive Subsidies when Employer-Sponsored Coverage is Available but Waived?

Q: If an employee elects medical coverage from an employer, but waives coverage for her spouse and child, will her dependents be eligible for any subsidies through the Health Exchange (Marketplace)?

A: (Assumption: their household income would otherwise qualify them to receive subsidies.) No, this family would not be eligible for subsidies if they had the opportunity to sign up under employer-sponsored coverage. The only way her dependents and spouse would be entitled to a subsidy would be if the employer-sponsored plan did not offer dependent or spouse coverage.
